The rules and agreements for using TorqBook.
These Terms of Service (“Terms”) govern your access to and use of the TorqBook mobile application, website, and related services (collectively, “TorqBook” or the “Service”). By creating an account or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy.
You must be at least 13 years of age to use TorqBook. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use TorqBook under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using TorqBook, you represent that you have the legal capacity to enter into a binding agreement in your jurisdiction and that you will comply with these Terms and all applicable laws when using the Service.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not you authorised it. Notify us promptly at support@torqbook.app if you suspect unauthorised access to or use of your account.
You agree to provide accurate and up-to-date information when creating your account and to keep this information current. We may suspend or terminate your account if we reasonably believe that any information you have provided is inaccurate, misleading, or incomplete, or if your account has been compromised.
Subject to your continued compliance with these Terms, TorqBook grants you a limited, personal, revocable, non-exclusive, and non-transferable licence to download, install, and use the app on devices you own or control, solely for your own personal, non-commercial use.
You must not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent such restrictions are prohibited by law or expressly permitted in writing by TorqBook.

You are responsible for your conduct while using TorqBook and for any consequences arising from that conduct.
TorqBook allows you to create, upload, submit, store, and share content, including vehicle information, maintenance logs, modification records, photos, posts, comments, and other materials (“User Content”). You retain ownership of your User Content.
By submitting User Content to TorqBook, you grant TorqBook a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to host, store, use, reproduce, modify, adapt, translate, display, perform, and distribute your User Content as reasonably necessary to provide, operate, improve, promote, and protect the Service.
You are solely responsible for your User Content and for ensuring that it does not violate these Terms or any applicable law. You represent and warrant that you have all rights necessary to grant the licence above and that your User Content does not infringe the rights of any third party.
Content that you post to any TorqBook community or social features (such as feeds, comments, likes, or similar functions) may be visible to other users of the Service. Do not post any information that you do not wish to make public, including personal or sensitive information such as home addresses, phone numbers, or financial details.
TorqBook is not obligated to monitor all User Content, but may review, remove, or restrict access to any content at its discretion, including where the content appears to violate these Terms or applicable law, or has been reported by users. We may also suspend or terminate accounts where we reasonably believe there has been a serious or repeated breach of these Terms.
TorqBook is a tool for recording, organising, and sharing vehicle-related information and experiences. It does not provide professional mechanical, safety, or legal advice and does not replace manufacturer recommendations, service schedules, or the advice of qualified professionals.
You are solely responsible for the condition, maintenance, and safe operation of your vehicle, and for complying with all applicable road rules, safety regulations, recall notices, and manufacturer guidance in your jurisdiction. Always consult a qualified mechanic or other professional if you are unsure about any maintenance or safety issue relating to your vehicle.
The Service (excluding User Content) and all associated intellectual property, including but not limited to the TorqBook name, logo, app design, underlying software, and any content provided by TorqBook, are owned by or licensed to TorqBook and are protected by copyright, trade mark, and other intellectual property laws.
Except for the limited licence granted in section 3, nothing in these Terms grants you any rights or licences in or to any TorqBook intellectual property. You must not use our trade marks, branding, or logos without our prior written permission.
TorqBook may integrate with or contain links to third-party services, websites, or resources that are not owned or controlled by TorqBook. Those third parties are responsible for their own services, content, and terms.
TorqBook is not responsible for the content, availability, or practices of any third-party services or websites, and your use of them is at your own risk. You should review the terms and policies of any third-party services you choose to use.
We aim to keep TorqBook available and running smoothly, but we do not guarantee that the Service will be uninterrupted, secure, or free from errors, bugs, or defects. Access to the Service may be suspended, limited, or modified from time to time for maintenance, upgrades, or other reasons.
We may modify, update, or discontinue all or part of the Service (including particular features or functionality) at any time, with or without notice, where reasonably necessary for operational, security, legal, or business reasons.
To the maximum extent permitted by law, TorqBook is provided on an “as is” and “as available” basis and TorqBook makes no representations or warranties of any kind, express or implied, about the Service. This includes any warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be error-free or uninterrupted.
Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantees, rights, or remedies that cannot be excluded under applicable law, including under the Australian Consumer Law where it applies.
To the maximum extent permitted by law, TorqBook and its owners, directors, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive losses, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Service.
To the extent that TorqBook’s liability cannot be lawfully excluded and to the extent permitted by law, TorqBook’s total aggregate liability to you for all claims arising out of or in connection with the Service or these Terms is limited to the greater of: (a) the amount you have paid (if any) to use the Service in the 12 months prior to the event giving rise to the claim, or (b) one hundred Australian dollars (AUD 100).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
You may stop using the Service at any time and may request deletion of your account via app settings (where available) or by contacting support@torqbook.app.
We may suspend or terminate your access to the Service (including your account) at any time if we reasonably believe that you have breached these Terms, created a risk or possible legal exposure for us or other users, or where we are required to do so by law or by a third-party service provider. Upon termination, the rights and licences granted to you under these Terms will cease, but sections that are intended to survive termination (including those relating to intellectual property, disclaimers, limitations of liability, and governing law) will continue to apply.
We may update these Terms from time to time, for example to reflect changes to the Service, our practices, or applicable laws. When we make material changes, we will take reasonable steps to notify you, such as by updating the “Last updated” date above, showing an in-app notice, or sending an email.
Your continued use of TorqBook after the updated Terms have taken effect will constitute your acceptance of the changes. If you do not agree with the updated Terms, you should stop using the Service and may request account deletion.
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Australian Capital Territory, Australia, without regard to conflict of law principles.
You submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory and any courts that may hear appeals from those courts in respect of any proceedings arising out of or in connection with these Terms or the Service.
